This Privacy Policy explains how we collect, use, share and protect the personal data of users of the OptiPay mobile application (available on Google Play and the App Store) and the website available at optipay.pl (together referred to as the "Application"). This Policy has been prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and with the Google Play requirements regarding data safety.

II. Data We Collect

In connection with the use of the Application, we may collect the following categories of data:

Account and contact data – the e-mail address provided during registration or payment, and optionally your name and phone number (e.g. when using the contact form).
Location data – the approximate or precise location of your device, used solely to display the nearest service points (car washes) on the map and to make it easier to choose a car wash. Location data is processed only after you have granted consent in your device's system settings, and you may withdraw it at any time.
Payment-related data – information necessary to process a transaction (amount, transaction identifier, payment status, the selected car wash and bay). Full payment instrument details (e.g. card number) are processed directly by the payment operator and are not stored on our servers (see section V).
App usage data – technical information such as the start and end time of using a service, device identifier, diagnostic data and logs, used to ensure the proper operation of the service, settlements with car washes and the handling of complaints.

III. Purposes and Legal Bases of Processing

Providing the services available in the Application, including processing and settling payments for car wash services – Art. 6(1)(b) GDPR (performance of a contract).
Displaying the nearest service points based on location – Art. 6(1)(a) GDPR (consent).
Handling complaints and contacting the user – Art. 6(1)(b) and (f) GDPR (legitimate interest of the controller).
Fulfilling legal obligations, in particular tax and accounting obligations (e.g. issuing an invoice or receipt) – Art. 6(1)(c) GDPR.
Ensuring security, preventing abuse and performing technical analysis (in anonymised form) – Art. 6(1)(f) GDPR.

IV. Google Play Requirements – Data Safety

Data is always transmitted over an encrypted connection (SSL/TLS).
We do not sell personal data to third parties. Data is shared only with the entities listed in section V and to the extent described therein.
The Application does not knowingly collect data of persons under 16 years of age. If we determine that such data has been provided, it will be deleted.
You may request the deletion of your account and associated data at any time – see section VII.

V. Data Recipients and Processors

Payment operator – payments are processed by the Przelewy24 service, owned by PayPro S.A. with its registered office in Poznań at ul. Pastelowa 8, 60-198 Poznań, KRS: 0000347935, NIP: 7792369887. PayPro S.A. is a separate data controller with respect to the transactions it processes.
Car washes operating within the OptiPay system – to the extent necessary to perform and settle the service rendered.
IT and hosting service providers – for the maintenance of the infrastructure, under data processing agreements.
Public authorities – only where the obligation to provide data arises from applicable law.

VI. Data Retention Period

Account-related data is stored for the duration of the account and, after its deletion, for the period necessary to settle services and to pursue or defend claims.
Data required by tax and accounting regulations is stored for the period required by those regulations (as a rule, 5 years).
Location data is not retained after the car wash selection session ends, beyond the scope necessary to carry out a specific transaction.

VII. Account and Data Deletion

You may request the deletion of your account and associated personal data at any time. To do so:

send a message to biuro@optipay.pl from the e-mail address associated with the account, or
use the form available on the Contact page.

After verifying your identity, we will delete the data that is not subject to further mandatory retention under applicable law (e.g. data required for tax settlements). Ratings and reviews left in the service may be retained in anonymised form.

VIII. Your Rights

In connection with the processing of your data, you have the following rights:

the right to access your data and obtain a copy of it,
the right to rectification (correction) of your data,
the right to erasure ("right to be forgotten"),
the right to restriction of processing,
the right to data portability,
the right to object to processing,
the right to withdraw consent at any time (without affecting processing carried out before its withdrawal),
the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, Poland).

IX. System Permissions (Consents) Used by the Application

Location – to display the nearest service points. Optional consent, which can be withdrawn in the device settings.
Internet access – necessary for the operation of the Application and for processing payments.
Camera / QR code scanner – to scan the QR code at a car wash bay (where the feature is available). Photos are neither stored nor transmitted.

X. Cookies and Analytics Technologies

The optipay.pl website uses cookies and analytics tools (including Google Analytics and Facebook Pixel) to ensure the proper operation of the website, to analyse traffic and for marketing purposes. You can manage cookies through your browser settings.

XI. Changes to the Privacy Policy

We reserve the right to update this Privacy Policy. We will inform you of any material changes through the Application or the website. The current version is always available at optipay.pl. In matters not regulated herein, the provisions of the Terms of Service shall also apply.
